Womack Accused Of Assaulting Process Server

Mendenhall Mayor Steve Womack has been charged with simple assault, Simpson County Sheriff Kenneth Lewis said.

Lewis said process server Donald Rankin went to Womack’s house on Sunday. Rankin told investigators that Womack swore at him and assaulted him.

Womack was arrested and charged, Lewis said.

"Simple assault could be anything from me grabbing your arm, or me stopping you, or a push — anything like that could be simple assault," Lewis said.

On July 1, 2011, Florida Statue 48.031 (7) went into effect. An association must now allow a process server access to the community, even one with a security gate, without announcing such entry to the residents. Yes, Florida Statute 843.01 states, "Whoever shall resist, obstruct or oppose any officer … or other person legally authorized to execute process in the execution of legal process … shall be guilty of a misdemeanor of the first degree." In other words, it’s unlawful to interfere and could be considered obstruction of justice.

Take notice that the Dallas County Constables will no longer be serving writs. Effective November 7, 2011, all writs will be delivered to the Dallas County Sheriff’s Office for service. Some Dallas County Constables have already discontinued accepting or attempting to serve documents that have already been issued by the County Clerk and District Clerk and are returning these instruments to the issuing departments. This has caused a delay in the processing of court documents. Until such time as the transition from the Dallas County Constables to the Dallas County Sheriff’s Office takes place, attorneys are being asked to consider the use of private process servers to ensure timely delivery of court documents. It is expected that the Dallas County Sheriff’s Office will make a full transition by the end of November.

Attorneys who have already paid for service and wish for service documents to be served by private processors are encouraged to contact the Constables’ Offices for arrangements to retrieve court documents. To inquire about refunds on prepaid service fees, please contact one of the following:

Another day, another story of Righthaven incompetence. The latest is that a process server that the company used, most likely for some of its hundreds of lawsuits against websites for supposedly infringing on copyrights, is now suing Righthaven for failing to pay its bills. The lawsuit, embedded below, is pretty straightforward. Legal Wings Inc. was used between May and October of 2010, for which it billed Righthaven to the tune of $5,670 — not a particularly huge sum. According to Legal Wings, Righthaven simply never paid, despite multiple requests to be paid. What strikes me as interesting here is that I can almost understand Righthaven’s recent efforts not to pay up the legal fees it owes, if you believe that the company is effectively out of cash and/or saving up its cash to fight the appeals. Obviously, there are reasonable arguments to be made that even that’s bogus, but if we can grant that assumption, the recent refusals to pay make at least some sense.
