A 55-year-old Minocqua man arrested after he allegedly pointed a gun at the head of a process server has been formally charged with second degree recklessly endangering another person’s safety and intentionally pointing a firearm at another person.
According to a criminal complaint filed late last week, a process server came to Keith G. Schultz’s Minocqua home April 18 to deliver court papers. The process server told police Schultz confirmed his identity, and appeared calm, but then reached behind his front door, pulled out a long gun and pointed it at her head.
“You need to get off my property or I will shoot you,” Schultz said, according to the process server.
The woman said she immediately left Schultz’s home and called police.

In its ruling Monday, the state Supreme Court said under C.R.C.P. 4(d), service according to international agreement is just one method for effecting service in a foreign country.
"Further, C.R.C.P. 4(d) does not require that service on a defendant located in a foreign country actually occur abroad and nothing in Rule 4(d) prohibits a plaintiff from serving a defendant within the United States if otherwise authorized," Justice Brian D. Boatright wrote for the majority.
As for C.R.C.P. 4(f), the Court said substituted service under the section provides a "valid alternative" to service abroad.
"We acknowledge that the Hague Service Convention is implicated when the law of the forum state requires the transmittal of documents abroad in order to effectuate service," Boatright explained.
"However, we conclude that the transmittal of documents abroad is not required to effectuate service under C.R.C.P. 4(f) and therefore the Hague Service Convention is not implicated by substituted service within the United States under Colorado’s Rules of Civil Procedure."
The Court made the rule absolute and remanded the case to the trial court.

Organisers of the Fat as Butter music festival will reappear in court to fight for $80,000 they are owed by US rapper Flo Rida, after his high level of security prevented him from being served legal documents.

The promoters are now asking the court to serve the rapper, whose real name is Tramar Dillard, via an email to his management or through his personal website and Facebook page.

Six months ago, the promoters of the Newcastle festival were left high and dry when Flo Rida, their headline act, did not show up.

On Friday, Judge Judith Gibson in the NSW District Court ordered Dillard to pay back $80,000 in performance and damage fees to the promoter Brent Lean from Mothership Music Pty Ltd.

But numerous attempts to serve the documents on Dillard while he is Australia have failed, Mothership’s lawyer Stephanie Borg from Neville & Hourn Legal said.

A process server who delivers court papers to Broward homes said she was bitten and bruised by a dog after its owners sent it to attack.

“The only thing I recall is doing this to protect my face,” said Yindra Lopez. “The dogs kept biting over here and over here and they were not stopping the dogs.”

Lopez said she was attacked by a 200-pound Bull Mastiff named Riley, who she said bit her on her arms and upper legs.

“I noticed that my arms started bleeding,” Lopez said. “I take the phone and I called 911.”

Lopez told NBC 6 that she followed court procedures when she arrived to serve papers at the Broward home. She said she identified herself with her ID card and her legal papers through the window.
